General Terms and Conditions

These Terms and Conditions govern the use of Autogrid.ch, the publication of vehicle listings and the purchase of listing packages.

1. Provider and contact

Autogrid.ch is a Swiss online platform for vehicle listings. It is operated by SargasWeb, Grossmatt 2, 8910 Affoltern am Albis, Switzerland, UID CHE-478.652.633. Contact for legal and contractual matters: info@autogrid.ch.

2. Scope

These Terms apply to all visitors, registered users, private sellers, garages, dealers and companies using Autogrid.ch or purchasing paid listing packages. Deviating terms apply only if confirmed by Autogrid in writing.

3. Role of Autogrid.ch

  • Autogrid provides a technical platform for publishing and searching vehicle listings.
  • Autogrid is not the seller, buyer, broker, agent or contractual party to any vehicle purchase between users.
  • Inspection, verification, price negotiation, purchase agreement, payment, handover, warranty and any reversal of a vehicle purchase take place exclusively between buyer and seller.

4. User account and obligations

  • Registration, profile, contact and company details must be truthful, current and complete.
  • Login details must be kept confidential. Actions carried out through an account are attributed to the respective user to the extent permitted by law.
  • The platform may not be used abusively, unlawfully, deceptively, disruptively or to bypass security or payment processes.

5. Listings and content

  • The advertiser is solely responsible for the accuracy, completeness and legality of vehicle data, prices, images, logos, descriptions, location and contact details.
  • Listings must not contain misleading information, infringing content, third-party trademarks or images without authorisation, offensive content or unlawful offers.
  • Autogrid may review, request changes to, reject, deactivate or delete listings that violate these Terms, legal requirements, third-party rights or platform quality standards.
  • A review by Autogrid does not confirm the accuracy, quality, availability or legality of a vehicle.

6. Listing packages, term and use

  • Free and paid packages are governed by the conditions, prices, listing limits and terms displayed on Autogrid.ch at the time of purchase.
  • Unless expressly stated otherwise, paid packages run for 365 days from activation and are paid in advance.
  • During the active term, users may delete, deactivate and publish new listings within the booked active listing slots. This does not extend the term.
  • Unused listing slots, deleted listings, sold vehicles or early non-use do not create any claim to extension, replacement, credit or refund.
  • Monthly billing or automatic renewal only applies if expressly displayed at purchase.

7. Prices, payment and contract conclusion

  • Prices are displayed in Swiss francs CHF. Any taxes or charges are shown where applicable.
  • For paid packages, the contract is concluded when the user confirms the purchase, payment through the payment provider is successfully completed and Autogrid activates or confirms activation of the package.
  • Payments are processed through external payment service providers, in particular Stripe. The terms of the relevant payment provider may also apply to payment processing.
  • If payment fails, is rejected or is charged back, Autogrid may refuse activation, deactivate listings or block access to the paid package.

8. No refunds for paid packages

Paid listing packages are digital platform services. After successful payment and provision or activation of the package, there is no right to a refund, partial refund or credit to the extent permitted by law. This applies in particular in cases of non-use, early termination, deleted listings, sold vehicles, lack of enquiries, listings rejected or removed due to a breach of these Terms, and changes to the user’s business model or discontinuation of use. Mandatory statutory rights remain reserved.

9. Visibility, availability and success

  • Autogrid strives to provide a stable and modern platform but does not guarantee uninterrupted availability, specific loading times, rankings, reach, enquiries or sales success.
  • Maintenance, technical issues, security measures or external services may temporarily restrict availability.

10. Rights to content

The user confirms that they have the necessary rights to uploaded texts, images, logos and other content. For the duration of publication, the user grants Autogrid a non-exclusive right to use such content on the platform, in search functions, previews, social media posts, marketing materials and technical displays where required for operation, presentation and promotion of the platform.

11. Suspension, deletion and termination

Autogrid may temporarily suspend or permanently delete accounts, listings or packages if there is suspicion of misuse, false information, rights violations, payment issues, security risks or breaches of these Terms. In such cases, fees already paid are not refunded to the extent permitted by law.

12. Liability

Autogrid is liable only for direct damages caused by intentional or grossly negligent conduct by Autogrid. Any further liability for indirect damages, consequential damages, lost profit, data loss, lack of sales success, user content, vehicle condition or agreements between users is excluded to the extent permitted by law. Liability for unlawful intent or gross negligence is not excluded in advance.

13. Data protection and communication

The processing of personal data is governed by Autogrid’s Privacy Policy. Contract-related notices may be sent by e-mail, through the user account or within the platform.

14. Changes to these Terms

Autogrid may amend these Terms where required due to legal, technical or economic changes. For already paid packages, the terms in force at the time of purchase apply unless mandatory reasons or legal requirements require a change.

15. Applicable law and jurisdiction

Substantive Swiss law applies, excluding conflict-of-law rules. The place of jurisdiction is the registered seat of the operator to the extent permitted by law. Mandatory statutory places of jurisdiction remain reserved.
